Title Insurance Steps

Step 1 – Request for Title Insurance

The requisition for title insurance usually comes from the buyer or the buyer’s attorney. The Gables Title Group team initiates searches that are necessary to confirm the chain of title. These searches are inclusive of county documentation, judicial searches, tax searches as well as municipality and state searches. All title abstracts and pertinent document titles are then used to confirm property chain of title.

Step 2- Examination

Our team uses their skill and expertise to complete an accurate title report. The title report is reviewed and analyzed, then we make an interpretive analysis of the documents as it pertains to the property title.

Step 3 – Commitment

We issue the title commitment on behalf of the insurer; this is an agreement to insure the title on the terms and subject to the requirements set forth. This commitment illustrates the amount of insurance, the parties insured, any exceptions or requirements that need to be in place to issue the policy.

Step 4 – Clearing the Clouds

Clouds are any information found that is not clear when we are looking into the title and pertinent documentation. Any irregularity within the chain of title that would cause a person to have a misgiving or lack clarity on the ownership of the property in question that needs to be addressed prior to the transfer of title is taken care of. Taxes are paid off, by the party that owes them and any mortgage left to be taken care of prior to the sale is also taken care of. This means that the buyer will receive the clean title of the property.

Step 5 – Closing

A title insurance policy, unlike other insurance, has a one-time payment. This premium is due on closing day, at the closing table.

Step 6 – Policy Issued

At the closing, as mentioned above, you pay for the title insurance bad receive the policy issued by our team on behalf of the insurer.
